Torture
I’m writing a paper on torture, the assignment is about researching international laws and the statues that the U.S follows in regards this issue. I have to make a “legal” argument stating whether the US is in violation of any laws. It may sound easy since an argument can go any way but for me since I’m new at this it will take some time.
Apparently according to the International Declaration of Human Rights the U.S is in violation of many articles of this declaration, so I thought it would be easy to write. Well it isn’t Bill Clinton wrote Executive Order # 13,107 and it says, I love copy and paste, “Nothing in this order shall create any right or benefit, substantive or procedural, enforceable by any party against the United States, its agencies or instrumentalities, its officers or employees, or any other person.”
Bill also wrote the following treaty
“Interagency Working Group on Human Rights Treaties
The designee of the Assistant to the President for National
Security Affairs shall chair the Interagency Working Group, which shall
consist of appropriate policy and legal representatives at the Assistant
Secretary level from the Department of State, the Department of Justice,
the Department of Labor, the Department of Defense, the Joint Chiefs of
Staff, and other agencies as the chair deems appropriate. The principal
members may designate alternates to attend meetings in their stead.”
The terms in questioned here are the National Security Affairs, Department of State, Department of Justice, and Joint Chiefs of Staff; These terms are written ambiguous. I found that they are, I didn’t think they were but they are, these terms do not include the intelligence agencies of the Department of State or the Central Intelligence Agency, this means CRAP. I want to find the US liable of torture but I can’t. Now I’m force to write that they are not.
I don’t know, I know from studying legal reasoning that I can not implement my personal believes into an argument, I believe that this will be hard to do. I’ll have to read more into the Declaration; I believe that if I can find somewhere on there that all nations and their affiliated agencies should obey by these regulations I may have a case. I’ll see.
